The client acknowledges to cancel a package or service 7 days prior to the deadline of their weekly direct debit. The client has reserves the right to request a cancellation to their signed contract. An email is required to be sent by the client to envisionfitnessinfo@gmail.com to request to offboard from Envision Fitness. Envision Fitness reserves the right to reject either the onboarding or offboarding requests if stated. The members of staff at Envision Fitness will ultimately have the decision to either allow you access to your bespoke health, fitness, and wellness program or initiate a momentary termination if any payments are awaiting to be transacted or if any payments have been missed by the deadline.

The The members of staff at Envision Fitness reserve the right to terminate packages or services at any time. This can occur in instances of general or gross misconduct such as: General Misconduct: • Unsatisfactory Attendance • Unsatisfactory Timekeeping • Any Form of Excessive Use of Profanity, Offensive, or Inappropriate Mannerisms/Language • Any Form of Negligent Mannerisms • Any Mannerisms That Harms Envision Fitness’ Reputation Gross Misconduct: • Any Form of Physical or Verbal Abuse • Falsification of Professional Registration & Eligibility to Work in The United Kingdom • Breach of Whistleblowing • Breach of General Data Protection Regulations • Unauthorised Use, Possession or Disclosure of Sensitive or Confidential Information & Details • Any Form of Bullying • Any Form of Racist Mannerisms • Any Form of Harassment • Any Form of Discrimination

• Any Form of Deception • Any Form of Blackmail

• Any Form of Fraud • Any Form of Gross Negligence • Any Form of Theft

• Any Form of Copyright Infringement • Any Form of Bribery • Any Form of Corruption • Any Form of Disrespect • Any Form of Threatening Mannerisms • Carrying, Taking or Being Under The Influence of Illegal Drugs or Alcohol • Discriminating Against Someone Because of Their Sex, Gender, Age, Race, Sexuality, Religion, Ethnic Background or Disability • Indecent or Inappropriate Behaviour, Fighting, Physical Violence or Threatening Someone With Physical Violence

The client acknowledges that during the 12 weeks of this contract, confidential information and details will be exchanged occasionally from the online coaches to the client. For this contract, the “confidential information and details” refers to all non-public information and details. The “confidential information and details” included are however not limited to your forename and surname, gender, ethnicity, religion, age/date of birth, address, occupancy, bank information and details, email address, mobile phone number, social media platforms, medical conditions, bespoke health, fitness, and wellness program, and any other proprietary or sensitive information and details disclosed by the client or the members of staff at Envision Fitness.

The members of staff at Envision Fitness and the client acknowledge to adhere to any information and details being confidential nor will be disclosed, reproduced, or distributed to any third party excluding if consent has been authorised by the client with the exceptions of it being:

• Required by law, regulatory authority, or court law: the Data Protection Act (2018) and the General Data Protection Regulations (GDPR). • Necessary to minimise any injury to the client, Online Coaches/Personal Trainer, or other individuals.

This privacy and confidentiality obligation will survive the termination of this contract. Any breach of this privacy and confidentiality policy will consequently result in potential legal action or liability including but not limited to claims for damages or injunctive relief.

The Envision Fitness website enables clients to purchase the available packages and services: Packages: 1.) - 'Bespoke Health, Fitness & Wellness Program': £215.88 1.) - ‘Weight Management’: £299.88 2.) - ‘Body Composition’: £299.88 3.) - ‘Strength & Conditioning’: £299.88 Services: 1.) - ‘Mindset/Life Coaching Sessions' (Accountability): £95.88 2.) - ‘Nutritional Screenings’: £95.88 3.) - 'Face-To-Face Personal Training Sessions': £359.88

Payments can be received via the Envision Fitness website via debit card, PayPal, or ApplePay. Or, an invoice will be sent to the client via their email address by the members of staff at Envision Fitness including the price, a description of the purchased package(s), services (if applicable), a deadline, and Envision Fitness’ terms and conditions. Payments will be required to be transacted monthly, and if any payments have been missed, the onboarding process will be terminated and the client will be offboarded effective immediately or a penalty fee will be required to be transacted within 7 days if any payments are missed. The duration of a package or service purchased by the client is valid for 12 weeks to ensure a lifestyle can be constructed that is realistic and sustainable for the client. If 12 weeks have passed, the purchased package or service will expire and be invalid. The package or service will require repurchasing it to resume being a client for Envision Fitness.

The client acknowledges that the members of staff at Envision Fitness cannot measure or anticipate the reaction of the client’s heart, lungs, or blood vessels with validity during the conduct of anaerobic or aerobic exercise (weight lifting and cardiovascular). This therefore imposes risks arising due to unforeseen circumstances that can potentially occur and consequently result in either a cardiac arrest, abnormal blood pressure, fainting, dizziness, unconsciousness, discomfort, or a stroke. The client acknowledges to release the members of staff at Envision Fitness from liability from any injuries, illnesses, diseases, accidents, incidents or deaths that can potentially occur.

The members of staff at Envision Fitness have purchased insurance via Hiscox (public liability and professional indemnity) covering any claims arising from third-party bodily injury, third-party property damage, or legal expenses, and the client will be required to submit a physical activity readiness questionnaire (PAR-Q) during the medical screening process.

Cancellations made between 0 - 24 hours' notice will consequently result in a penalty fee of £24.99. This is a non-negotiable. Cancellations made will not be rescheduled, excluding if cancellations are made over 24 hours.

Envision Fitness reserves the right to reject refund requests, whether justifications include injuries, illnesses, diseases, accidents, incidents, or relocations.

If a member of staff at Envision Fitness cancels an online or face-to-face consultation, check-in or personal training session, the member of staff at Envision Fitness will reschedule the consultation or check-in based on the client’s availability schedule.

Cancelling Your Bespoke Health, Fitness & Wellness Program Subscription:

1.) - You have the right to cancel this contract within 14 days from the start of the contract without giving any reason, but you must let us know you wish to do so within the 14-day period. You may email us at envisionfitnessinfo@gmail.com.

2.) - In case of dispute you must show that you cancelled the contract in accordance with the cancellation terms, but for these purposes it will be sufficient to show that you sent your communication concerning your exercise of the right to cancel before the cancellation period had expired.

3.) - If you have requested an immediate membership start date and you cancel your subscription within the 14-day period, proportionate charges will be due. We will refund to you any subscription amounts you have paid us. An amount in proportion to the number of days between the start of your subscription and the date you communicated to us that you wanted to cancel. Refunds will be made no later than 14 days after the day on which we were informed about your decision to cancel, and will be made using the same means of payment you used for the initial transaction.

4.) - After the 14-day cancellation period you may terminate your subscription at any time by cancelling your direct debit mandate with your bank, or by contacting our member service team if you pay via recurring card payment. No refunds will be given for unused billing periods; if you would like to continue using your bespoke health, fitness, and wellness program until the end of your billing period please contact our member service team prior to cancelling your payments, otherwise your membership will cease immediately.

5.) - We will terminate this contract and your subscription with immediate effect if you do not pay any applicable subscription amounts, we may terminate this contract and cancel your subscription with immediate effect on notice to you if you breach any of our terms and conditions. In this event you will no longer be able to access any of our bespoke health, fitness, and wellness programs and we will not give any refund.

6.) - If we do not terminate your subscription if you breach any of the terms and conditions, or if we give you extra time to pay if you do not pay your subscription amounts when it falls due, that will not prevent us from subsequently enforcing our terms and conditions.

The members of staff at Envision Fitness are philosophical about the morals and ethics of constructing health, fitness, and wellness programs bespoke to clients. The members of staff at Envision Fitness cannot anticipate the results of their packages or services nor make any representation and/or warranties that the client will meet their weight management, body composition, and strength and conditioning goals.

If any provision of this contract is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

​This contract shall be governed by and interpreted per the laws of the United Kingdom, without regard to conflict of law principles.
